1. What Kindo is
Kindo is a record-keeping and coordination platform for informal loans between people who already know each other. We help two users — a borrower and a lender — agree to terms, track repayments, and rate each other.
Kindo is not a bank, lender, broker, money-services business, or financial institution. Kindo does not lend its own money, charge interest, hold deposits, or guarantee repayment. Each loan is a private agreement between the two users involved.
2. Eligibility
- You must be at least 18 years old (or the age of majority in your jurisdiction).
- You must be legally able to enter into a binding contract.
- You must use Kindo only for personal, non-commercial purposes between people you actually know.
- You must comply with the laws of your country, including any rules on personal lending, usury caps, tax reporting, and anti-money-laundering laws that apply to you.
3. Your account
You are responsible for keeping your password safe and for everything that happens under your account. Tell us immediately at security@kinfund.app if you suspect unauthorised access. We may suspend or close any account that breaks these terms or is used for fraud, abuse, or illegal activity.
4. Loans between users
When a borrower posts a request and a lender accepts it, a private agreement forms between those two users. Kindo records the agreed amount, currency, duration, interest rate, and payment schedule.
- You decide the terms. Kindo does not set, recommend, or enforce any specific interest rate or schedule.
- You are responsible for legality. Both parties must ensure the rate, fees, and any tax or reporting consequences comply with the laws of their country.
- Money changes hands between you, not us. Whether you settle by bank transfer, cash, or an online payment method linked through Kindo, the funds move directly between borrower and lender or via a third-party payment processor.
- Repayment is the borrower's obligation. Kindo does not collect repayments, chase missed payments, or guarantee any return.
5. Payments and online settlement
If you choose to settle online via a third-party payment processor (such as Stripe), your transaction is subject to that processor's terms and fees. Kindo is not a party to that transaction. Disputed charges, chargebacks, and refunds are governed by the processor's rules. Kindo is not responsible for processor outages or for funds delayed in transit.
6. Ratings, content & conduct
You may post ratings, reviews, and notes about people you have transacted with. You agree your content will be truthful, lawful, and respectful. You will not:
- Harass, defame, or threaten any other user.
- Post false information, deceive, or impersonate anyone.
- Use Kindo for money laundering, terrorist financing, or any illegal activity.
- Attempt to access another user's account or data, or break the platform's security.
- Use automated tools to scrape or overload the service.
We may remove content or suspend accounts that violate these rules, and we will cooperate with lawful authorities where required.
7. Fees
Kindo itself currently does not charge users a platform fee. If we introduce fees in the future we will give you notice and the chance to decline before any charge applies. Third-party processor fees (e.g. Stripe) are passed through transparently and shown before you confirm any online payment.
8. Disputes between users
Any disagreement about the existence of a loan, the terms, or whether a payment was actually made is between the borrower and lender. Kindo will provide the records of your activity on the platform on reasonable request, but we are not the arbiter of your private agreement. You agree to resolve such disputes directly and, if necessary, through the courts or alternative dispute resolution available in your jurisdiction.
9. No financial advice
Kindo provides tools and calculations for your convenience. The savings benchmark, projected return, interest schedule, and rating systems are informational only and do not constitute financial, investment, tax, or legal advice. Get advice from a qualified professional before making any financial decision.
10. Disclaimer of warranties
Kindo is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy of calculations, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure.
11. Limitation of liability
To the maximum extent permitted by law, Kindo and its officers, employees, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or money lent to another user. Our total aggregate liability for any claim arising out of or related to the service is limited to the greater of (a) the fees you have paid Kindo in the 12 months before the claim, or (b) the equivalent of USD 100.
Some jurisdictions do not allow certain limitations — in those places our liability is limited to the minimum permitted by law.
12. Indemnity
You agree to indemnify and hold Kindo harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your use of the service, your loans with other users, your content, or your breach of these terms.
13. Termination
You may close your account at any time from your profile page. We may suspend or terminate your account if you breach these terms or for legal, security, or platform-integrity reasons. Sections that by their nature should survive termination (including liability, indemnity, and dispute provisions) will continue to apply.
14. Changes
We may update these terms from time to time. If a change is material we will notify you in-app or by email. Continued use of Kindo after the change takes effect means you accept the new terms.
15. Governing law
These terms are governed by the laws of England and Wales, without regard to conflict-of-laws rules. The courts of England and Wales have exclusive jurisdiction over any dispute that is not between two users (which is governed by Section 8 above), unless mandatory consumer-protection laws in your country provide otherwise.
